Terms & Conditions of Use

Services that are provided by YesJob through this Website, any YesJob website or through the YesJob Smartphone Mobile Application - to either Employers, Job Seekers or other YesJob users such as Advertisers – are subject to these Terms & Conditions of Use (“Terms and Conditions”) and the YesJob Privacy Statement (“Privacy Statement”). 

If you do not accept these Terms and Conditions and/or the Privacy Statement, please do not join, access, view, download or otherwise use any services offered by YesJob via this Website, any YesJob website or the YesJob Smartphone Mobile Application.

By your continued use of this Website, any YesJob website or the YesJob Smartphone Mobile Application, you are acknowledging that you have read and understood these Terms and Conditions and the Privacy Statement and that you agree to be bound by all provisions of the Terms and Conditions and the Privacy Statement.

YesJob reserves the right to amend, add to, delete or revise these Terms and Conditions and / or Privacy Statement at any time and without prior notice. You are advised to regularly review these Terms and Conditions and the Privacy Statement.

Your access to any YesJob service through this Website, any YesJob website or through the YesJob Smartphone Mobile Application will be terminated upon your notice to YesJob that any change made to these Terms and Conditions or the Privacy Statement is unacceptable - otherwise your continued use of any YesJob service shall constitute your acceptance of all changes that may be made from time to time and they shall be binding upon you.

Definitions

In these Terms and Conditions, the following terms shall have the respective meanings specified below unless the context otherwise requires:

  • "YesJob" means PT YESJOB TECHNOLOGY INDONESIA, or any YesJob company whether a parent or subsidiary of PT YESJOB TECHNOLOGY INDONESIA.
  • “Employer” means any company or individual who registers a YesJob Employer Account.
  • “Job Seeker” means anyone that downloads the YesJob Smartphone Mobile Application and registers their profile data.
  • “Site” means any YesJob website or smartphone mobile application owned and operated by YesJob and its affiliates/subsidiaries or its service providers.
  • “Service” means any YesJob service provided through any YesJob Site
  • The terms “you”, “user” and “users” refer to all and any individuals or entities that access and/or use any YesJob Site at any time for any reason or purpose whatsoever.

Conditions Applicable to Site Users

Conditions Applicable to Employers
Any Employer using the Site must be a minimum of 18 years old. Any Employer using the Site confirms and states that he/she is at least 18 years old.

An Employer agrees that it shall only use the Site for lawful purposes and for promoting any job related activities or for advertising/promotional purposes.

Upon registering a YesJob Employer Account at a Site the Employer will be entitled to use the Site to advertise job vacancies and to receive any YesJob related services, whether free of charge or paid for as per the terms of the service provided by YesJob.

An Employer agrees and acknowledges that it shall be solely responsible for the contents of any materials contained in any job vacancy advertisement that is posted by the Employer or by the Employer’s representative on the Site.

An Employer agrees and acknowledges that YesJob has the unrestricted right to remove or edit, or require the removal or amendment of, any job vacancy advertisement on the Site as it sees fit and appropriate, or to terminate or suspend an Employers access to and use of the Site and/or any services offered on or through the Site, if YesJob believes that an Employer is placing illegitimate or untrue job vacancy advertisements, adding fake, illicit or illegal material to a job vacancy advertised on the Site or abusing YesJob services in any way, or failing to comply with these Terms and Conditions or in accordance with legal requirements as imposed from time to time by authorized institutions.

An Employer agrees and acknowledges to only place job vacancies on a Site that are real and factual, and that all information contained in any job vacancy that an Employer places on a Site is correct and true.

An Employer agrees and acknowledges that it can never include within any job vacancy on a Site any telephone number or email address that would enable a Job Seeker to directly respond to such Employer job vacancy by using telephone or email.

An Employer agrees to keep his/her login name and password with care and not to disclose them to any other person. An Employer is solely responsible for maintaining the confidentiality, safekeeping and security of such login name and password and shall notify YesJob immediately of any unauthorized use of the same.
An Employer agrees and acknowledges that any Job Seeker data sent to or submitted by YesJob to an Employer has not been verified as correct and true by YesJob and that YesJob has no liability whatsoever for the accuracy or truth of any Job Seeker data as sent to or submitted by YesJob to an Employer. This includes profile information or contact details.

An Employer agrees and acknowledges that if they choose to pay to view the contact details of a Job Seeker and it subsequently turns out that the contact details of the Job Seeker are not valid that YesJob shall refund the cost of purchasing that Job Seekers contact details into the Employers YesJob Employer Account as a credit balance.

An Employer agrees and acknowledges that if they choose to pay to view the contact details of a Job Seeker and it subsequently turns out that the Job Seeker does not respond or reply to the Employer that this in no way is the liability of YesJob. YesJob can in no way ensure that a Job Seeker will reply to an Employer after the Employer has paid to view the contact details of the Job Seeker. YesJob is not liable in anyway whatsoever if a Job Seeker decides not to reply to an Employer after the Employer has paid to view that Job Seekers contact details and tried to contact that Job Seeker via such contact details. There shall be no refund in such circumstances.

An Employer agrees and acknowledges that YesJob uses a 3rd party payment gateway to facilitate all payment transactions via the YesJob Web Portal and that any transaction costs associated with such transaction via the 3rd party payment gateway will be transferred to the Employer and added to the cost of purchasing YesJob credit.

An Employer agrees and acknowledges that YesJob uses a 3rd party payment gateway to facilitate all payment transactions via the YesJob Web Portal and that YesJob is in no way liable for errors or issues that are due to the error, mistake or failure of the 3rd party payment gateway provider. If there are any issues associated with payment, the Employer should contact yesJob immediately and YesJob shall contact the 3rd party payment gateway provider and do all it can to correct such issues as fast as possible.

An Employer agrees and acknowledges that YesJob is simply an intermediary that helps to connect Employers with job vacancies to Job Seekers and that YesJob is in no way liable for the accuracy of any Job Seeker information that is submitted by YesJob to an Employer and that YesJob is not liable in anyway whatsoever for the ramifications of any false or incorrect Job Seeker data sent to or submitted by YesJob to an Employer.

YesJob does its best to ensure that any Job Seeker data is not illegal, unethical or offensive in nature but an Employer agrees and acknowledges that YesJob is not responsible for the type or nature of any Job Seeker data that is sent to or submitted by YesJob to an Employer.

YesJob shall have the right to terminate any services offered to any Employer and to remove any job vacancy advertisement posted on a Site by an Employer at YesJob’s sole discretion, without any compensation or recourse to an Employer, in the event that the relevant Employer or the contents of the relevant job vacancy advertisement is or are in breach of any of the provisions in these Terms and Conditions or any YesJob product specifications.

An Employer agrees and acknowledges that when paying for and receiving any YesJob service that payment in no way whatsoever guarantees or assures the validity or accuracy of any Job Seeker data that is sent or submitted by YesJob to the Employer.

An Employer agrees and acknowledges that YesJob reserves the right to change any service fee that it charges from time to time or to initiate new charges or service fees, from time to time, as YesJob deems fit and appropriate. In the event that any Employer fails to pay an applicable service fee or any other fees or charges due to YesJob, YesJob reserves the right to suspend or terminate the Employers job vacancy listings or Employer Account.

An Employer agrees and acknowledges that YesJob can at anytime and whenever it wishes advertise the contents of a job vacancy that an Employer has listed on any YesJob Site in any way that YesJob chooses and that such job vacancy information would be publicly viewable to any User of the Site. The Employer agrees and acknowledges that by using YesJob’s services it accepts that the details of any job vacancy, including Company Name, can be posted on any Site that YesJob deems fit and proper.

An Employer agrees and acknowledges that YesJob is only an intermediary providing certain services that are designed to help Employers with their recruitment process. An Employer agrees and acknowledges that YesJob does not perform any background checks on any Job Seeker unless such specific services have been paid for by the Employer, and in such cases YesJob still is not liable in anyway whatsoever for the accuracy of any such background data check information provided.

An Employer agrees and acknowledges that YesJob is in no way liable for any of the actions or behavior of any Job Seeker that the Employer chooses to meet, interact with or hire. The Employer takes on all risk and responsibility in its interactions with any Job Seekers that are introduced to the Employer through the Site.

An Employer agrees and acknowledges that YesJob uses 3rd parties for provision of payment services and that YesJob is not liable in anyway whatsoever for technical issues or problems with any payment that is made by an Employer if due to the fault of the 3rd party payment provider and not under the control or authority of YesJob.

YesJob confirms that an Employer may delete their Employer Account at any time. If the Employer deletes their Employer Account then all job listings will cease to be shown / advertised. YesJob has the right to store the details of any job listings in its job listing database for a reasonable period of time.

Conditions Applicable to Job Seekers

Any Job Seeker using the Site must be a minimum of 18 years old. Any Job Seeker using the Site confirms and states that he/she is at least 18 years old.

A Job Seeker confirms that all data that they upload or submit to YesJob during registration or subsequently add or edit, is true, accurate and correct at the time of data upload, submission or editing. A Job Seeker agrees and acknowledges that YesJob is not liable in anyway whatsoever for any false, inaccurate, unethical or illegal data that a Job Seeker uploads or submits to a YesJob Site.

A Job Seeker agrees that he/she shall only use the Site for lawful purposes, for seeking employment, better job opportunities or for information about jobs or careers.
A Job Seeker agrees to keep his/her login name and password with care and not to disclose them to any other person. A Job Seeker is solely responsible for maintaining the confidentiality, safekeeping and security of such login name and password and shall notify YesJob immediately of any unauthorized use of the same.
A Job Seeker confirms and acknowledges that he/she discloses his/her personal data and all other information that they submit to YesJob freely and voluntarily and at their own volition.

A Job Seeker confirms and acknowledges that his/her personal data will be sent by YesJob to the Employer each and every time that he/she applies to a job via a YesJob site. Personal data can include any and all information that the Job Seeker has submitted or uploaded to a YesJob Site – except YesJob Site password details.

A Job Seeker confirms and acknowledges that an Employer, who has listed a job vacancy that the  Job Seeker has applied to or clicked/swiped “Interested” to, may require proof and authenticity of any of the personal data that the Job Seeker has uploaded or submitted to a YesJob Site.

A Job Seeker confirms and acknowledges that when uploading or submitting his/her data to a YesJob Site that such data will be stored on the YesJob database indefinitely. When a Job Seeker uses the Site for purposes of submitting, uploading or posting his/her data the Job Seeker authorizes YesJob to store his/her data and information in the database of YesJob for an unlimited time period (“Database”).

A Job Seeker confirms and acknowledges that if he/she deactivates his/her YesJob account that YesJob shall still hold the Job Seekers data on the YesJob database so that the Job Seeker can reactivate their account again in the future if he / she wishes to.  

A Job Seeker confirms and acknowledges that he/she has provided valid and accurate contact detail information.

YesJob confirms that an Employer may choose to list a job vacancy in multiple and different ways and that a Job Seeker may send his/her data directly to an Employer via another means – not via a Site - even if the Employer is advertising such job vacancy on a Site.

A Job Seeker confirms and acknowledges that his/her personal data will remain active on a YesJob Site and will be stored in the YesJob Database at his/her own risk until he/she chooses to delete such YesJob account.

A Job Seeker acknowledges and agrees that his/her data may be seen, reviewed and accessed by any Employer who submits a job vacancy to a YesJob Site which the Job Seeker says they are Interested in / apply to.

A Job Seeker acknowledges and agrees that when clicking or swiping “Interested” to a job vacancy listed on a YesJob Site that they are applying to such job vacancy and that his/her data will be sent to the Employer advertising such job vacancy.

A Job Seeker acknowledges and agrees that YesJob reserves the right to reject, disapprove or edit any part of a Job Seeker’s data as it sees appropriate and to erase any personal data where YesJob reasonably believes that such data is inaccurate, false, illegal, rude, unethical, unlawful, infringes copyright / trademark / trade name / trade secret or infringes any other intellectual property rights or invades the privacy of another person.
A Job Seeker acknowledges and agrees to YesJob’s practice of charging Employers a fee or fees for various services that YesJob provides to Employers through the Site, which includes the Employers ability to pay to view the contact details of a Job Seeker that has applied to a job vacancy that the Employer has advertised on a YesJob Site and also paying for YesJob to assist the Employer with their recruitment process or assess the suitability of Job Seekers for job vacancies that the Employer has listed on a Site. A Job Seeker also acknowledges and agrees that he/she shall have no claims whatsoever to any such fee received by YesJob from any Employer for its services via the Site.

A Job Seeker agrees and acknowledges that YesJob is in no way liable for any of the actions or behavior of any Employer or Employer staff that the Job Seeker chooses to meet, interact with or start employment with. The Job Seeker takes on all risk and responsibility in its interactions with any Employers that are introduced to the Job Seeker through the Site.

YesJob confirms that it will not release a Job Seeker’s personal data to any person or entity except an Employer where the Job Seeker has specifically applied / clicked or swiped Interested to a job vacancy that that Employer has advertised on the Site - unless required by any authorized institution or obliged under the prevailing laws and regulations of a country.

YesJob confirms that it will not allow Employers to have access to the YesJob Database of Job Seeker data. YesJob shall only send an Employer the personal data of a Job Seeker if and when a Job Seeker has specifically applied / clicked or swiped Interested to a job vacancy that that Employer has advertised on the Site.

A Job Seeker acknowledges and agrees that YesJob may unrestrictedly use a Job Seeker’s personal data to allow YesJob to generate Site user statistics and also provide advertisers with targeted advertising services that are focused on certain types of Site users. However in providing this service to advertisers YesJob confirms that it shall never provide Advertisers with access to the YesJob Database of Job Seeker data or the ability to review Job Seeker data itself.

Although YesJob restricts access to the YesJob Database only to relevant personnel of YesJob, or authorized service providers and only sends a Job Seekers data to Employers where a Job Seeker has specifically applied to a job offered by such Employer, YesJob does not guarantee that other parties will not, without YesJobs consent or access, somehow gain access to the Database. A Job Seeker may deactivate their YesJob account at any time. A Job Seeker agrees and acknowledges that YesJob is not liable for any unlawful access to the YesJob Database by any 3rd parties without the consent of YesJob.

A Job Seeker agrees and acknowledges that Employers who have gained access to a Job Seeker’s data, as the Job Seeker applied to a job advertised by that Employer, may have retained a copy of such Job Seeker data even when the Job Seeker subsequently deletes or deactivates their YesJob account. YesJob is not responsible for the retention, use or privacy of data in these instances, or for the use or privacy of data by any such Employer while the data is in the Database.

A Job Seeker agrees and acknowledges that YesJob will not be responsible or held liable in any way whatsoever if any Employer or other User, in breach of these Terms and Conditions, whether in Indonesia or elsewhere, uses the Job Seeker’s personal data, information or materials for any purpose other than for recruiting potential employees. A Job Seeker agrees and acknowledges that all personal data, information or materials that are sent or transferred by YesJob to an Employer about a Job Seeker when the Job Seeker applies to an Employer job vacancy through the Site, are sent or transferred entirely at the Job Seeker’s own risk.

Prohibited Site Uses
All Users agree that:

  1.  Job Seeker shall not post any non-career related information or data and/or incomplete, false or inaccurate career related information or data on the Site.
  2. A Job Seeker shall not respond to any job vacancy advertisement for any reason other than to apply for the job advertised by an Employer.
  3. An Employer shall not respond to any Job Seeker other than in connection with the Job Seeker’s  application for a job vacancy as posted by the Employer.
  4. Any communications or use of the Site for any purposes other than recruitment process purposes, including but not limited to soliciting of donations or business for any reason, are strictly prohibited.
  5. All users shall not use the Site in any manner that infringes upon the intellectual property rights or proprietary rights of any others or YesJob.
  6. All users shall not print, download, duplicate, transmit or otherwise copy, reproduce, re-distribute, republish or use any personally identifiable information about any other users except that Employers may print, download or use Job Seeker data that is sent or submitted to them by YesJob about Job Seekers that have applied to an Employer job vacancy.
  7. All unsolicited communications of any type to users are strictly prohibited.
  8. All users shall not delete, revise or remove any material posted by any other person or entity.
  9. All users are prohibited from violating or attempting to violate the security of the Site including, without limitation, accessing data not intended for them or logging into a server or account which they are not authorized to access, attempting to probe, scan or test the vulnerability of a system or network or attempting to breach security or authentication measures without proper authorization, attempting to interfere with the service to any user, host or network or sending unsolicited e-mail, including promotions and/or advertisements for products or services without the prior written consent and approval of YesJob. Violations of system or network security may result in civil and/or criminal liabilities.
  10. All users shall not upload, post, publish, transmit, distribute, circulate or store any material in whatsoever way relating to the Site (i) in violation of any applicable laws or regulations; (ii) in any manner that may infringe the copyright, trademark, trade secrets or other intellectual property rights or proprietary rights of others or violate the privacy or publicity or other personal rights of others; (iii) that is harmful, defamatory, libelous, obscene, discriminatory, harassing, threatening, abusive, hateful, racist, blasphemous, false, illegal, improper or is otherwise offensive or objectionable; (iv) in the manner that causes unrest in politics, religion, national security or the stability of YesJob; or (v) that contains viruses, trojan horses, worms, corrupted files or other materials that may interrupt, damage or limit the functionality and operation of the Site, the services offered on the Site, or of any computer software or hardware or telecommunication equipment of other Users.
  11. All users are prohibited in using screen scraping, data mining, robots or similar data gathering and extraction tools on the Site for establishing, maintaining, advancing or reproducing information contained on the Site on your own website or in any other publication, except with YesJob’s prior written consent and approval.

Intellectual Property Rights

All Users acknowledge that the contents of the Site, including without limitation information, text, graphics, images, layout, designs, pictures, logos, editorial content, HTML and other proprietary materials on the Site (collectively “Contents”) are the intellectual property of YesJob or its licensors and are protected by copyright, trademark, patent and other intellectual property laws.

All Users acknowledge and agree that the Site Contents made available by YesJob are solely for the Users personal non-commercial use. Except as otherwise provided in this paragraph, users shall not, and shall not procure, assist or facilitate any third party to, copy, reproduce, transmit, publish, disseminate, distribute, redistribute, broadcast, circulate, store (in any medium), display, modify, sell or transfer or participate in the sale or transfer of or offer for sale of, create derivative works from, or in any way exploit any of the Contents, whether in whole or in part. Users may download or copy the Contents solely for their personal non-commercial use and/or uses that are expressly permitted in these Terms and Conditions, provided that users will not delete or amend any symbols or statements in the Contents that indicate the subsistence therein of copyright, trademark and any other proprietary rights.

Users do not have any right, title or interest in or to any or any part of the Contents as a result of such downloading or copying. YesJob reserves all of its rights of enforcement for all its intellectual property rights or proprietary rights in any Contents, including without limitation against any use of any of the Contents that is not expressly permitted under these Terms and Conditions. For the avoidance of doubt, any purported consent of any third parties (including Employers) to the use of the Contents or any part thereof shall not in any way exonerate the users from the restrictions/prohibitions imposed hereunder in whatsoever manner.

Responsibility

YesJob reserves the right to monitor the Site and its contents at any time, but is not obliged to do so. YesJob takes no responsibility whatsoever for any material on the Site that is not posted by YesJob itself or is posted by YesJob on behalf of a user. All users acknowledge and agree that they are fully responsible for the form, content and accuracy of any resume, personal data, information, data, advertisement, web page and/or material submitted by them to YesJob or that is otherwise posted by them on or through the Site. YesJob does not warrant that any resume, personal data, information, data, advertisement or web page will be viewed by any specific number of users or that it will be viewed by any specific user or result in successful recruitment of personnel.

YesJob shall not in any way be considered an agent of either an Employer or a Job Seeker with respect to any use of the Site. YesJob shall not be responsible in any way for any decision, for whatever reason, made by any user that either seeks a job or posts a job on a Site, or of any party responding to or posting advertisements on a Site.

Whilst YesJob is focused on providing a high quality service to Users it does not warrant that the Site will operate error-free or that the Site and its server(s) are free of viruses or other harmful mechanisms, that any defects will be corrected, or that the operation of the Site will be uninterrupted, timely or secure.

If use of the Site or its Contents results in the need for servicing or replacing equipment or data, by any user, YesJob shall not be responsible for any of these costs and any loss or damage of whatever nature. The Site and its Contents are provided on an “as is” basis without any warranties of any kind. To the fullest extent permitted by law, YesJob disclaims all warranties, including without prejudice to the foregoing, any warranties in respect of merchantability, availability of featured products or services, non-infringement of third party rights, fitness for particular purpose, or about the accuracy, reliability, completeness, timeliness or other qualities of the Site and the Contents, services, software, text, graphics and links contained therein. Users should independently assess and verify the accuracy, completeness and reliability of any information on the Site and to seek professional advice where necessary.

Own Risk

ALL USERS USE THE SITE AND ANY LINKS PROVIDED IN ANY SITE ENTIRELY AT THEIR OWN RISK.

All Users shall be responsible for their own communications and are responsible for the consequences of their activities on the Site.

YesJob does not represent or guarantee the truthfulness, accuracy or reliability of any of the communications posted by other Users or endorse any opinions expressed by Users.

Any reliance by Users on any material posted by other Users shall be at their own risk.

YesJob reserves the right to expel any Users and prevent their further access to the Site at any time for breaching these Terms and Conditions or violating laws and regulations and also reserves the right to remove any material which is abusive, illegal, disruptive or inappropriate at YesJob’s sole discretion without notice and/or consent and/or compensation whatsoever.

Links to Other Websites

The Site may contain links to third-party sites. These are provided solely as a convenience to Users and as Internet navigation tools, and not in any way as an endorsement by YesJob of the contents on such third-party sites. Unless otherwise stated on the Site, YesJob has no control over or rights in such third-party sites and is not responsible for their availability, security or accuracy. If Users access any linked third-party sites, they do so entirely at their own risk.

YesJob shall not be responsible for the contents of any third-party sites linked to the Site or any links contained in such third-party sites or any changes or updates thereto, and does not make any representations or warranties regarding the contents or accuracy of materials on such third-party sites. YesJob shall not be responsible or liable for any loss or damage of any kind arising from or in connection with the use of the services or contents of such third-party sites. Further, any Employer job vacancy data posted on the Site by any Employer may be viewed by Users of other websites linked to the Site and YesJob shall not be responsible for any improper use by any user or third-party other than YesJob of any data or materials posted on the Site.

Indemnity

All Users agree to indemnify, and hold harmless YesJob and its associated companies, officers, directors, employees, agents, proprietors, partners, representatives, shareholders, servants, attorneys, predecessors, successors and assigns from and against any claims, actions, demands, injuries, liabilities, losses, damages, costs and expenses (including legal fees and litigation expenses on a full indemnity basis) arising from or relating to their use of the Site or its contents or their breach of these Terms and Conditions, to the fullest extent permitted by applicable law. This indemnification shall be in addition to all other obligations of users under these Terms and Conditions, and shall not prejudice any other rights or remedies available at law to YesJob.

Disclaimer

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YESJOB AND ITS ASSOCIATED COMPANIES, OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS SHALL NOT BE LIABLE IN ANY EVENT FOR DAMAGE OF ANY KIND SUFFERED BY ANY USERS WHATSOEVER DIRECTLY OR INDIRECTLY ARISING FROM OR RELATING TO THEIR USE OF OR INABILITY TO USE THE SITE AND ITS CONTENTS, INCLUDING WITHOUT LIMITATION ANY ERRORS OR OMISSIONS IN SUCH CONTENTS, OR ANY DELETION, INCORRECT OR DELAYED TRANSMISSION OR LOSS OF ANY CONTENTS OR MATERIALS UPLOADED OR TRANSMITTED THROUGH THE SITE.

Dealing with Employers

User’s communication or business dealings with, or participation in promotions organized by, Employers found on or through the Site, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between User and such Employer. YesJob shall not be responsible or liable for any loss or damage of any type or nature incurred as a result of any such dealings or as a result of the presence of the Employers on the Site or as a result of the accuracy or truthfulness of any information or data posted by the Employers.

Dealing with Other Users

Notwithstanding that YesJob uses its best endeavors to provide impartial recruitment process services, and supports the exchange of information between Employers and Job Seekers, and provides advertising services, YesJob will not be involved in dealings or disputes between a Job Seeker or Employer or Users for any reason whatsoever and YesJob shall not be responsible or held liable for the quality, security and legitimacy of the recruitment process services that it provides.

YesJob does not warrant or guarantee the accuracy of any information provided in a Site and/or Job Seeker data provided by a Job Seeker and/or Job Vacancy information provided by an Employer. YesJob does not guarantee that an Employer will be able to pay the relevant remuneration to a Job Seeker that is hired via a Site or that a Job Seeker will be competent to take the job offered to them by an Employer via a Site. Should any dispute arise between Employer and Job Seeker or Job Seeker and Employer or any users, such parties should resolve such disputes between themselves and all parties agree and acknowledge that YesJob shall not be responsible or held liable in anyway whatsoever for any disputes.

Limitation of Liability

Without prejudice to the above and subject to the applicable laws, the aggregate liability of YesJob to any user for all claims arising from or relating to his/her use of YesJob’s services and a Site shall be limited to the amount of any fees received by YesJob in respect of the specific services that have given rise to such claims.

Termination
In the event that any information provided by a user is inaccurate, in breach of any laws or contains indecent elements, YesJob shall instantly abrogate the user’s account and membership without notice and reserves the right to take such action as it considers appropriate, desirable or necessary including but not limited to taking legal actions against such user. YesJob reserves the right at any time to immediately terminate or suspend any user’s account or access to the Site without notice, where YesJob is of the opinion that the user has breached any of these Terms and Conditions or violated any law or regulation, and to take any further action as YesJob in its sole discretion considers appropriate, desirable or necessary, including removing any material which it deems abusive, illegal, disruptive or inappropriate. YesJob shall have the sole and absolute discretion to decide whether the user, Job Seeker or Employer or other has breached any of these Terms and Conditions, and such decision shall be final. In case YesJob has not exercised the right under this Clause, it shall not be deemed to be a waiver.

Modification to Access of Site

YesJob reserves the right at any time and from time to time to modify, change, suspend, discontinue or restrict: (a) users’ access to, either temporarily or permanently, a Site (or any part thereof); or (b) the whole or any portion of a Site (and the services provided therein), with or without notice. YesJob shall not be liable to users or to any third party for any such modification, change, suspension, discontinuation or restriction.

Security Measures

YesJob will use its reasonable endeavors to ensure that its officers, directors, employees, agents and/or contractors exercise their prudence and due diligence in handling any personal data submitted by a Job Seeker and that access to and processing of personal data by such persons is on a “need-to-know” and “need-to-use” basis. YesJob will use its reasonable endeavors to protect Job Seekers personal data against any unauthorized or accidental access, processing or erasure of the personal data.

Governing Law and Jurisdiction

These Terms and Conditions and any dispute or matter arising from or incidental to the use of a Site shall be governed by and construed in accordance with the laws of the Republic of Indonesia.
Any dispute, controversy or claim arising out of or relating to these Terms and Conditions including the validity, invalidity, breach or termination thereof, shall be settled by arbitration in accordance with the applicable Arbitration Rules in force. The place of arbitration shall be in Indonesia.

In the event of any breach of these Terms and Conditions by a party, the other party shall be entitled to remedies in law and equity as determined by arbitration.

Force Majeure

Without prejudice to the provisions of these Terms and Conditions limiting or disclaiming liability, YesJob is not liable for any delay or failure in performance resulting directly or indirectly from causes beyond its reasonable control, including, without limitation, failure of the internet, power failure, failure of computer, telecommunication or other equipment, strikes, labor disputes, riots, insurrections, civil disturbances, shortage of labor or materials, fires, floods, storms, explosions, act of God, war, governmental actions, orders of domestic or foreign courts and non-performance of third parties.

Entire Agreement

These Terms and Conditions shall constitute the entire agreement between a user and YesJob relating to his/her/its use of a Site, and shall replace and supersede all other communications (be it written or oral), discussions, letters and contracts relating to the subject matters hereof.

Severability

The provisions of these Terms and Conditions shall be enforceable independently of each other and the validity of each provision shall not be affected if any of the others is deemed invalid. In the event that any provision or any part of a provision of the Terms and Conditions is determined to be or becomes illegal, invalid or unenforceable, the validity and enforceability of the remaining provisions or remaining part of the provision of the Terms and Conditions shall not be affected and, in lieu of such illegal, invalid, or unenforceable provision or part of a provision, there shall be added as part of the Terms and Conditions one or more provisions as similar in terms as may be legal, valid and enforceable under the applicable law.

Variation of Terms

YesJob may vary these Terms at any time. If YesJob varies these Terms, it will provide notice by publishing the varied Terms on the Site. All Users accept that by doing this YesJob has provided you with sufficient notice of the variation to its Terms and Conditions.

Agreement and Acceptance

Any user of a Site agrees and acknowledges that by using a Site that they are agreeing to and accepting all of the YesJob Terms and Conditions.
